GENERAL TERMS AND CONDITIONS OF SALE

Part I: Scope of compliance
The clauses define the general terms and conditions of sale via Editions Braun Internet shop. Editions Braun head office is located 24 rue Jacques Mugnier 68200 Mulhouse and is recorded with RCS N° Siret 330 481 771 00054, with a capital of € 200,000.
Our offers shown on Internet are exclusively reserved to personal customers, other than professional retailers.
The buyer only has to click on “General Terms and Conditions of Sale” (indicated hereafter G.T.S.C.) to know the conditions of its order, before even he has started the process of order. Consequently, placing an order implies whole acceptance without reserve of the buyer with these G.T.S.C. Without any particular and agreed written stipulations between the parts, all the orders are automatically subjected to the present G.T.S.C.

Part 2: Validation
These G.T.S. C. apply to any order you place through Editions Braun website. You must read these G.T.S. C. carefully. By placing an order through the Website, you confirm that you have entirely read, understood and agreed to these G. T.S.C.
Part 3: Delivery
Editions Braun are committed respecting the average delivery time as indicated on Website site during the placement of order, but it does not constitute a time of rigor and Editions Braun will not be able to see their committed responsibility in the event of delay of delivery. Delivery in France will be ensured by Colissimo or by another courier; delivery for other countries by FedEx or another courier. Parcel tracking number will enable you to follow your order.
Shipment of your order will be done within eight days following validation of this one.
All information stated by the buyer at order placement engages this one: in the event of error in the wording of the coordinates of the recipient (in particular name, first name, number and street name, postcode, name of city, phone number or e-mail address), the vendor could not be held responsible for the impossibility in which it could be to deliver the product. Delivery delay cannot give place to damages. However, if 2 weeks after the indicative date of delivery, the product were not delivered, for any other causes that an emergency, the sale could then be solved and the buyer to obtain restitution of his payment other than any other allowance or damages. Are regarded as emergency discharging the vendor from his obligation to deliver: war, riots, fire, strikes. The vendor will keep the buyer informed in convenient time in case of above enumerated events. Anyway delivery within deadlines only can be ensured if the buyer is up to date of his obligations towards the vendor.

Part 4: Payment
Payment is made as specified at placement of order. Buyer supports a part of delivery fees, which is paid by placing the ordering. Any purchase is due cash at placement of the order.
Payment of the goods is done at placement of order and only by credit card (Visa, MasterCard).
A protected procedure of credit card payment via Internet was set up. This procedure is based on information encoding technology, real reference of protected payment. By issuing your payment, number and validity date of bank card are registered and immediately encrypted at once in your computer before being sent on Internet. Thus, no confidential piece of information circulates on the network without to have been beforehand encrypted.
The customer guarantees that it is fully entitled to use the credit card of which it makes use and that he has sufficient funds to cover the costs of the order.

Part 5: Complaint
At receipt of the goods, the buyer immediately must check their state and their conformity compared to the order. If the parcel is damaged, the buyer must refuse it and make it note by the post office or the courier. All the anomalies (damaged, missing goods, wrong quantity or reference) compared to the placed order acknowledgment received, must be writing sent within a period of 48 hours at receipt of the goods, in the absence of what the right to complaint will cease being acquired.

Part 6: Guarantee Exchanges or Refunding
In accordance with articles 1641 and following of the Civil code, the vendor guarantees the buyer, in any event, of all the detrimental consequences of the defects and latent defects which would be likely to reveal the sold goods, provided the latter are announced to him as of their appearance. On any assumption, the buyer will have to bring back the proof of the existence of the latent defect to the day of the delivery. The freight fees of return will then be completely refunded with the buyer and the exchange implemented immediately. The offers of product are valid within the limit of stocks available. In the event of stock shortage, Braun Editions will inform the buyer by e-mail of unavailability. Refunding or exchange against another article will be proposed to the buyer.
In the event of refunding, we will issue a check, within a time lower or equal to 15 days following the date of receipt of the returned parcel. No sending against refunding will be accepted, whatever is the reason. Braun Editions reserve the possibility of not confirming an order for any reason, holding in particular with the availability of the products, a problem relating to the received order (i.e.: illegible document), an abnormal order or a foreseeable problem concerning the delivery to be carried out. Braun Editions are committed informing of it the customer by any means at his disposal.
In addition, your satisfaction appearing essential to us you have a right to repossess. Whatever is the reason, you can return us any bought item in the seven days following the receipt of your parcel (in its packing of origin imperatively and with the corresponding invoice), by specifying us the reason for the return at : Editions Braun, 24 rue Jacques Mugnier, 68200 Mulhouse – FRANCE . The return fees remain then with your load. We commit ourselves carrying out the refunding of the returned items under about fifteen days, provided that returned goods were not damaged further to awkwardness of the buyer or to a badly packing before return.

Part 7: Price
Freight fees and costs are shown in Euros. The price is entirely due in one single payment at order placement. All the orders are invoiced and due in Euros only.
For any delivery external to the Metropolitan France, the possible custom charges or local taxes are to pay by the buyer are to be paid at the time of an additional invoice.

Article 8: Transfer of property - Transfer of risk
Transfer of property of the products to the buyer, will be carried out only after complete payment of the price by this last, and this whatever the delivery date of the concerned products. On the other hand, the transfer of the risks of loss and deterioration of the products will be carried out at delivery and receipt of the aforesaid products by the Buyer.

Article 9: Right of access and of correction
Braun Editions process all your personal data with the strictest confidentiality. At the placement of your orders, we only ask for essential information, and we prohibit any use of the data communicated on the site for another use that for a quality treatment and attentive follow-up of our customer relationship. In accordance with the Data-processing law and Freedoms of January 6th, 1978, you have a right of access and correction of your personal data. By placing your order, we only record certain information, (name, first name and postal address), necessary to the treatment of your order. Since you will have become customers of our company we will be likely to address our commercial offers by any means to you, of which e-mail, when they seem to us likely to interest you. Article 10: Intellectual property
Images shown on this website are it with an only aim of promoting and of selling reproductions of original works of which the rights are held by Braun Editions and the creative artists of original works. These images could not be reproduced by some process that it is, nor sold and/or distributed. He is explicitly prohibited to sell any electronic or printed reproduction contents of this site.
While connecting Braun Editions Website, the customer avoids copying or downloading whole or part of his contents, except prior and express approval of Braun Editions, which is titular of the whole of the intellectual property laws being referred to it.

Article 11: Applicable law
All the clauses appearing in the present general terms and conditions of sale, so as all purchasing and selling operations which are aimed there, will be subjected to the French Right.

Article 12: Buyer approval
Present general terms and conditions of sale, as well as the price lists, are expressly approved and accepted by the Buyer, who declares and admits having a perfect knowledge of it, and gives up so, to prevail itself of any contradictory document and, in particular, its own general terms and conditions of purchase: the act of purchase involving acceptance of these general terms and conditions of sale. The present conditions are constantly modifiable without previous notice.
